Illinois Divorce Process

How an Illinois Divorce Case Generally Moves Forward

No two divorces follow exactly the same path, but a case may involve filing and service, temporary issues, exchange of financial information, parenting arrangements when children are involved, negotiation or mediation, and entry of a final judgment. Contested issues may require motion practice, evidentiary hearings, or trial.

  1. Starting the case. A petition is filed and the other spouse receives formal notice or otherwise appears in the case.
  2. Early and temporary issues. The parties may need short-term arrangements involving parenting, support, possession of property, bills, or other immediate concerns.
  3. Financial and parenting information. Income, assets, debts, and other relevant information are exchanged. Cases involving children may also require parenting proposals and child-related information.
  4. Resolution. Many issues are resolved by agreement, negotiation, or mediation; unresolved issues can be decided by the court.
  5. Judgment and post-decree matters. The final judgment sets the parties' legal obligations, and later enforcement or modification issues may arise.

What to gather for an initial meeting

Useful records can include recent tax returns and pay information, bank and retirement statements, mortgage and debt information, documents concerning major assets, existing court orders, and a proposed parenting schedule if children are involved.
